Stephanie asks:

My ex owes me approximately £9,000, as I lent him this money when we were together to help him sort out his debt problems.

We agreed that he would pay me back at £110 a month. He was paying me regularly until about nine months ago when he stopped and has only paid me on odd occasions since. I contact him every month asking for some money from him but he’s now refused to pay me any more money.

We don't have a signed agreement to pay back the debt, however I do have the evidence of the full amount of money going out of my bank account and into his bank and then regular amounts coming into my bank account from him. How can I get my money back from him?

This is a verbal agreement and there is evidence of regular payments having been made in the past. The debt should be taken to the Small Claims court, where your ex-partner will have to swear or confirm that any information that he gives is true.

If you prefer, you can start the claims process online at moneyclaim.gov.uk . You will need to know where your ex is living (which I’m assuming you do) and you have to pay the court fees by credit or debit card.

The threat may be enough encourage him to start the payments again.
